Atlas Privacy Policy — launch draft
Review draft prepared September 20, 2026; not effective. An effective date has not been set. Existing users will receive at least 14 days’ notice before material changes take effect. This draft describes the proposed U.S., age-18-and-over public beta. The current policy continues to govern until replacement.
Atlas is operated by Aetherion Arc LLC, a California limited liability company. This Policy covers Atlas at atlascfi.com, its applications, assistant connector, APIs, and other Atlas services that link to this Policy (the “Service”). It explains our handling of personal information alongside our Terms of Service.
1. Information we collect
Depending on the features you use, we collect:
- Account and relationship information: name, email, role, account identifiers, eligibility confirmations, school membership, instructor relationships, and invitations.
- Training information: lesson plans, debriefs, instructor observations, assignments, quiz responses, progress, logbook entries, currency evidence, uploaded documents, aircraft and schedule information, and conversations or memories you save in Atlas.
- Audio and derived information: recordings you submit, transcripts, lesson metadata, recording-consent records, and resulting drafts or debriefs. A recording stored only on your device has not necessarily been uploaded or archived in Atlas.
- Sensitive information you or an authorized person provide: medical-certificate status and training-eligibility information. Avoid uploading medical histories, government identification, or other sensitive documents that a feature does not need.
- Connector information: the client or assistant you connect, permissions, authorization and expiration records, token-related security records, and API activity. An assistant may also send Atlas your instructions, queries, and content needed for an operation.
- Signatures and acceptance records: signatures or approvals you deliberately apply and evidence of legal acceptance, such as document versions, timestamps, IP-derived records, and user-agent information.
- Billing and fulfillment information, when applicable: plan and payment status, limited payment details, and shipping/contact information for an order you actually place. Stripe processes payment credentials; Atlas does not receive or store your full card number. The free public beta does not require payment information.
- Optional integrations: data supplied by an integration you authorize, as described below or at connection time.
- Technical and usage information: browser and device information, IP addresses, server logs, pages and features used, timestamps, and security events. Optional product analytics is disabled during this free beta. Security logs and records needed to enforce usage allowances remain in use.
Information can come from you, your authorized assistant, an instructor or school with an appropriate relationship to you, an integration you connect, or your use of the Service.
2. How we use information
We use information to provide accounts and training workflows; retrieve relevant sources; generate requested responses, transcripts, and debriefs; maintain records; support collaboration and authorized integrations; deliver requested communications; handle purchases when offered; provide support; prevent abuse; and comply with legal obligations.
We use aggregate, de-identified usage information to improve the Service. We do not sell personal information, share it for cross-context behavioral advertising, or use training information for advertising. We do not use your training content to train general-purpose AI models. We limit sensitive information to the features and purposes reasonably expected by the person providing it, rather than using it to infer unrelated characteristics or for advertising.
3. Connected assistants and API access
You may choose to connect a third-party assistant, including Muse where supported. Atlas receives authenticated requests from that assistant and returns the information needed for permitted operations. Depending on your approved permissions and existing access rights, this can include your profile, training progress, lesson plans, schedules, logbook records, tasks, saved memories, source documents, and authorized instructor or school information. Write permissions can also allow the assistant to submit supported requests or drafts and make other changes described when you grant access.
Permissions limit the categories of operations a connection may perform; they do not grant the assistant a school role or access to another person's records that you could not otherwise access. Some permissions cover multiple related types of information. Review the permission descriptions before connecting, and use the narrowest access that meets your needs. Connecting an assistant does not give it authority to sign an instructor endorsement or make a pilot-in-command decision.
The assistant provider receives the information returned to it and handles that information under its own terms, privacy policy, and account settings. It may retain conversations or copies independently of Atlas. An independently chosen assistant provider is not simply another Atlas service provider processing all of that information on our instructions. Review its retention, model-training, and sharing settings before connecting, particularly when your records contain information about other people. Atlas's no-training commitment does not control a third-party assistant's independent processing.
You can review and revoke Atlas connections in Atlas's assistant connection settings. Disconnecting in the assistant's own settings may also be necessary. Revocation prevents future authorized Atlas access through that grant; it does not remove information the assistant already received. Deleting your Atlas account or revoking a connection does not by itself delete the assistant provider's conversations or backups. Direct those requests to that provider as well. Contact support@atlascfi.com if you cannot revoke a connection.
Do not put passwords, access tokens, or other credentials into ordinary chats, documents, or support messages. Use only the supported secure connection flow.
4. AI processing provided by Atlas
When you use Atlas AI features, relevant inputs and context may be sent to providers that help us deliver those features. These include Anthropic for generated responses, OpenAI for audio transcription, ElevenLabs for voice generation, and Voyage AI for text embeddings used in search and retrieval. Document text or search queries may be processed to create embeddings; audio may be processed to produce transcripts. Providers receive information needed for the feature you use, which may include personal information contained in that material.
We do not authorize our AI service providers to use your training content to train general-purpose models. Their processing is subject to our applicable service arrangements and settings. This commitment is distinct from independently chosen connected assistants described in Section 3. AI outputs can be inaccurate; the Terms explain the need for human review and authoritative aviation sources.
5. Service providers and other recipients
The following providers support enabled Atlas features. A listing does not mean every provider receives every user's information:
| Provider | Purpose and relevant information |
|---|---|
| Supabase | Authentication, databases, and storage for account and application data. |
| Vercel | Application hosting and delivery, including requests and associated technical information. |
| Cloudflare | Domain/DNS services and associated technical information; any additional traffic processing depends on the services configured. |
| Anthropic | AI generation using relevant instructions and training context. |
| OpenAI | Transcription of audio submitted through enabled transcription features. |
| Voyage AI | Embeddings of document text and search queries for retrieval. |
| ElevenLabs | Voice generation for enabled audio features. |
| Resend | Transactional email, recipient addresses, and message content. |
| PostHog | Optional product analytics; disabled during this beta. |
| Optional Gmail integration and airport/place services. | |
| Twilio | SMS or voice notifications when enabled. |
| Stripe | Payments and billing for purchases or existing subscriptions. |
| Fulfillment vendors and carriers | Contact, order, and shipping information if you order physical goods. |
We use service arrangements appropriate to these providers' roles and limit disclosures to their purposes. We update this Policy when our practices materially change. We may also disclose information when required by law, to protect rights and safety, to investigate abuse, or as part of a business transfer subject to applicable privacy obligations.
6. Optional Gmail integration
If you connect Gmail for SchedulePointe sync, we store authorization tokens and use the gmail.readonly permission. This Google permission technically permits broader mailbox access, but Atlas's SchedulePointe integration queries messages from postmaster@mail.schedulepointe.com and uses them to synchronize lesson schedules; it does not use the connection to read unrelated email. You can disconnect the integration from Atlas and revoke its access through your Google account.
Our use of information received from Google APIs follows the Google API Services User Data Policy, including its Limited Use requirements.
7. Instructor and school access
Atlas supports shared training relationships. Information associated with those relationships may be visible to your authorized instructor or school staff according to the feature, your role, and the records involved. Shared information can include lessons, progress, observations, training activity, eligibility status, and conversations shared through applicable training features. School membership does not make every private document or assistant memory universally visible.
Instructors and schools are independently responsible for their own use of information. Ending a relationship removes access based on that relationship, but does not necessarily erase records the instructor or school created, legitimately retained, or previously exported. Their recordkeeping obligations and policies may also apply. Your personal account and records are not transferred to a school merely because it pays for school features. Contact us if you need help understanding access or leaving a relationship.
8. Recordings and participant permission
Before recording or uploading a lesson, obtain and document all participant permissions required by applicable law and school, airport, and aircraft rules. An Atlas checkbox or recording indicator does not itself establish that everyone consented. Do not record someone without the required permission. Submitted recordings, transcripts, and debriefs are training information and may be available to authorized participants in the applicable training relationship. Transcription and generated observations can be wrong; review them before relying on or sharing them.
9. Cookies and similar technologies
Atlas uses cookies or browser storage for functions such as sign-in and session continuity. Optional product analytics is disabled during this free beta. Any later analytics activation will be described with the applicable privacy choices before it takes effect. We do not use these technologies for cross-context behavioral advertising. Browser controls can limit cookies or clear local storage, but doing so may affect sign-in or other functions. Contact support about analytics choices. This Policy does not claim that disabling a browser cookie deletes server records or previously collected information.
10. Retention, export, and deletion
We retain personal information while your account is active and as needed to provide the Service and meet the purposes described here. If you delete your account, we delete or de-identify your personal information within 30 days, and purge it from routine backups on the normal backup cycle, except when retention is needed to comply with law, resolve disputes, prevent fraud, enforce agreements, or maintain required transaction records. Separately maintained school or instructor records are subject to Section 7. We may retain aggregate, de-identified information that cannot reasonably identify you.
You can request access, a copy of your information, correction, or deletion at support@atlascfi.com. Use any available in-product export or deletion controls as well. Copies already sent to your chosen assistant or another independent recipient must also be managed with that recipient.
11. Security
We use reasonable administrative, technical, and organizational safeguards, including encryption in transit, access controls, and row-level data isolation between schools. No system can guarantee absolute security. We will provide notification of a personal-information breach when required by law.
12. Privacy requests and rights
Depending on applicable law, you may have rights to know or access information, obtain a portable copy, correct inaccuracies, request deletion, limit certain sensitive-information uses, object to or restrict certain processing, withdraw consent where processing relies on consent, or appeal a denied request. We do not sell personal information or share it for cross-context behavioral advertising. We do not discriminate against you for exercising applicable privacy rights.
Contact support@atlascfi.com. We may verify your identity and an agent's authority before acting. We will respond within the applicable legal timeframes, explain a denial, and provide applicable appeal information. Some requests concerning independently maintained school records may need to be addressed to the school; we will explain that distinction. Nothing in this Policy limits rights that cannot lawfully be waived.
13. Launch eligibility and international processing
The public beta is intended for adults 18 and older in the United States. Do not create a beta account for a minor or upload a minor's personal training records. If you believe a minor's information was provided, contact support so we can investigate and take appropriate action. We will handle any pre-existing accounts that do not meet the beta eligibility rules through a separate transition process.
Atlas is operated from the United States. Our hosting and providers may process information in the United States or other locations relevant to the services they provide. U.S. launch availability does not eliminate rights under laws that otherwise apply, and this Policy does not ask you to waive them. We will evaluate additional legal bases, transfer safeguards, notices, and age-related protections before expanding public availability internationally or to minors.
14. Changes and contact
We will publish an updated version with an effective date and provide notice by email or in-app at least 14 days before material changes take effect. When a change requires consent, we will request it rather than treating this Policy alone as consent.
Aetherion Arc LLC — support@atlascfi.com.
Atlas Terms of Service — launch draft
Review draft prepared September 20, 2026; not effective. An effective date has not been set. Existing users will receive at least 14 days’ notice before material changes take effect. This draft describes the proposed U.S., age-18-and-over public beta. The current Terms continue to govern until replacement.
Please read carefully. These Terms include binding individual arbitration and a class-action waiver (Section 17), an express assumption of the risks of flight training (Section 9), and limits on liability (Section 13). You may opt out of arbitration within 30 days as explained in Section 17.6. Atlas is a study and workflow aid, not a certificated flight instructor or a substitute for the judgment of your instructor or pilot in command.
1. Who we are and what these Terms cover
Aetherion Arc LLC is a California limited liability company ("we," "us," or "our"). These Terms govern Atlas at atlascfi.com, its applications, assistant connector, APIs, and other Atlas services that link to these Terms (the "Service"). "Affiliates" means entities that control, are controlled by, or are under common control with Aetherion Arc LLC. References to us include Affiliates where the context requires, including intellectual-property ownership, indemnification, and liability limits.
By affirmatively accepting these Terms when creating an account or when prompted to accept an updated version, you agree to them. If you act for an organization, you represent that you are authorized to bind it. Our Privacy Policy explains how we handle personal information. Acknowledging that Policy does not replace any separate consent required for optional integrations, recordings, or other processing. If you do not accept these Terms, do not use the Service.
2. What Atlas provides and the limits of its role
Atlas is an educational study aid and workflow tool. It is not a certificated flight or ground instructor, flight school, FAA-designated examiner, aircraft dispatcher, or official source of aeronautical information.
Atlas can store user-entered records and support review or signing by appropriately authorized people. An AI response, computed summary, draft, or suggested endorsement does not itself create a valid endorsement, authorize flight or solo, establish eligibility for a checkride, or guarantee currency, recency, airworthiness, or training outcomes. Whether a record satisfies a particular requirement depends on its actual contents, evidence, required human actions, and applicable law.
A schedule is not proof that a lesson was flown. A shared plan is not a signed debrief. A booking request is not a confirmed reservation, and an invoice draft is not a payment. Currency summaries depend on the records and assumptions identified with them and may omit facts Atlas does not have.
The pilot in command and authorized instructor remain responsible for aeronautical decisions and compliance with 14 C.F.R. Verify relevant claims against current regulations, charts and official weather, applicable aircraft POH/AFM and supplements, and appropriately authorized instruction. A school template or AI suggestion cannot override an applicable regulatory requirement or aircraft limitation. Instructors must verify endorsement language against current requirements, including AC 61-65 as applicable, before signing. Atlas does not replace required training or the applicable testing standards.
3. Eligibility and accounts
The public beta is available to adults 18 and older in the United States. Do not create a beta account for someone under 18 or upload a minor's personal training records. Availability and eligibility for a third-party assistant are governed separately by that provider's rules. An instructor or school account does not override Atlas's beta eligibility requirements.
Provide accurate account information. Keep your credentials secure, do not sell or transfer your account, and promptly report suspected unauthorized access to support@atlascfi.com. Use Atlas's supported connection and collaboration mechanisms rather than sharing passwords. You remain responsible for activity you authorize, including actions through a connected assistant. We will handle pre-existing accounts outside the beta eligibility rules through a separate transition process.
4. Free access, optional purchases, and existing subscriptions
Free public beta. Creating a free beta account does not require a payment card, does not begin a paid trial, and does not authorize an automatic charge. A free account does not become a paid subscription merely because the beta ends or pricing changes. A paid purchase requires a separate offer showing its price and material terms and your affirmative agreement.
We may change beta features, reasonable usage limits, or future availability. We will explain applicable limits and provide notice of material changes under Section 22. Free beta access is not a promise of unlimited processing, permanent availability of every feature, or free physical equipment. Third-party assistants may charge separately under their own terms.
Existing purchases and future paid offers. The free beta does not itself cancel or amend a subscription, hardware order, or school agreement you already accepted. Those purchase-specific terms continue to govern that purchase. If we offer new paid plans, checkout or an order form will disclose the included features, price, billing interval, any minimum commitment, renewal and cancellation terms, applicable taxes, and any trial's end and first-charge date. There is no default 30-day paid trial, automatic school pilot conversion, 12-month school commitment, or included recorder unless your accepted offer specifically provides for it.
Where you affirmatively subscribe to a recurring plan, it renews as disclosed until canceled. Manage an existing subscription through account billing settings or contact support@atlascfi.com. Cancellation stops the next renewal according to the accepted terms and applicable law; access normally continues through the paid period. Refund rights follow applicable law and the accepted purchase terms. Nothing here limits the right to dispute an unauthorized or erroneous charge.
Payments are processed by Stripe when applicable. A failed payment may restrict paid features, but the existence of a payment dispute is not by itself a waiver of your statutory rights. Ending paid access does not by itself delete your existing training records; existing records remain available in read-only form subject to account security, lawful retention, and these Terms. School payment does not give a school ownership of a student's personal account or authorize broader data access.
5. Intellectual property & your license to use
All software, content, models, prompts, design, trademarks, and systems in the Service are owned by Aetherion Arc LLC or its Affiliates and licensors and are protected by intellectual-property law. We grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for its intended purpose, subject to these Terms. All rights not expressly granted are reserved. You may not copy, reproduce, modify, distribute, sell, publicly display, create derivative works from, or reverse-engineer any part of the Service without our express written permission.
6. Your content, connected assistants, and feedback
Your content. You retain ownership of content you submit, including notes, recordings, transcripts, lesson plans, logbook records, observations, and documents ("User Content"). You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, and display that content only as necessary to provide and secure the Service and carry out your authorized instructions. We may permit service providers to perform those functions on our behalf and transmit content to recipients you authorize. This permission does not give us a general right to commercialize your training content or sell it.
We do not use your training content to train general-purpose AI models or authorize our AI service providers to do so. We may improve the Service using aggregate, de-identified usage information as described in the Privacy Policy. Your license ends when the relevant content is deleted, except to the extent retention or continued processing is necessary for authorized shared records, backups, legal obligations, or the other retention exceptions in the Privacy Policy. You must have the necessary rights and permissions for content you provide, including third-party manuals and recordings.
Connected assistants and API access. You may authorize a third-party assistant to use supported Atlas operations within the permissions you approve and your existing account rights. Some permissions allow reading information; others allow submitting supported changes, drafts, or requests. Review permissions and the intended action carefully. Granting access does not appoint the assistant as an instructor or authorize it to apply your professional signature. Writes, drafts, approvals, reservations, and payments have the distinct statuses shown by Atlas; an assistant's description cannot change those statuses.
A connected assistant may receive information returned by Atlas and process or retain it under that provider's own terms and privacy practices. Atlas does not control that independent processing or guarantee the assistant's accuracy or availability. The Privacy Policy explains the data exchange. You can revoke a connection in Atlas, but revocation does not recall information already received by the provider. Never place access credentials into ordinary chat or share another person's account. Using an authorized connector does not bypass school permissions, legal-acceptance requirements, or applicable usage limits.
Feedback. If you voluntarily provide suggestions about Atlas, you allow us to use that feedback without compensation. This feedback permission does not expand the license to your personal training records or confidential documents.
7. Acceptable use
You agree not to:
- Violate applicable law, regulations, or another person's rights.
- Misrepresent your identity, certification, school role, or authority; fabricate signatures or evidence; or access another person's records without authorization.
- Upload or disclose another person's information without the required permission, including through a connected assistant.
- Bypass access controls, circumvent usage limits, misuse credentials, interfere with the Service, or introduce malware.
- Extract proprietary Service material without permission or use other people's training records to build or train a model without appropriate rights.
- Rely on Atlas or a connected assistant as the sole basis for a flight, dispatch, maintenance, endorsement, currency, or safety-of-flight decision.
Using documented APIs and connectors within your permissions, exporting your own records, and ordinary authorized school administration are permitted. These permissions do not authorize redistribution of licensed third-party materials. Violations may result in suspension or termination under Section 18.
8. Instructor, school, and recording responsibilities
If you use Atlas as an instructor or school, you represent that you hold the authority you claim and use the Service consistently with applicable regulations and school procedures. A shared account or assistant grant does not confer a certificate or professional authority.
Any endorsement, signed logbook entry, recommendation, or sign-off is the professional act of the authorized human who applies it. You are responsible for reviewing its accuracy, current legal requirements, evidence, and required wording before signing. AI-generated text and unsigned drafts are not substitutes for that review.
You must have appropriate authority and required permissions to submit or access another person's records. Respect the feature's sharing settings and the boundaries of each training relationship. A school's subscription does not authorize unrestricted access to students' private data or export to unrelated assistants.
Before recording or uploading audio, obtain and document every consent required by applicable law and relevant school, airport, and aircraft rules. An interface indicator or checkbox is not proof that another participant consented. Do not infer a medical diagnosis or present uncertain speaker attribution or transcription as verified fact. Review generated observations against the source material.
9. Assumption of risk & aviation disclaimer
Flight training and aviation are inherently dangerous activities that can result in serious injury or death. ATLAS is a study and workflow aid only; it does not fly aircraft, supervise training, or reduce the inherent risks of aviation. You expressly acknowledge and assume all risks arising from flight training and aviation and from your use of, or reliance on, the Service, including any errors, omissions, delays, or unavailability of the Service.
To the fullest extent permitted by law, you release Aetherion Arc LLC and its Affiliates from claims for ordinary negligence arising from your use of the Service. This release does not apply to, and nothing in these Terms purports to waive, liability for gross negligence, recklessness, willful or intentional misconduct, fraud, or any liability that cannot be waived under California law (see Cal. Civ. Code §1668). You remain responsible, together with your PIC and CFI, for every aeronautical decision.
10. Artificial intelligence
Atlas uses AI services for features such as responses, retrieval, transcription, and generated voice. The Privacy Policy identifies the relevant providers. Independently connected assistants may also interpret Atlas data and generate their own answers.
AI output can be incomplete, outdated, or wrong and can state incorrect information confidently. We do not independently verify every generated output before you see it. Verify important information against primary sources and your appropriately authorized instructor. Generated observations should distinguish what a source establishes from an inference or an unanswered question. Do not treat a missing record as proof an event did not occur, or a draft as a completed professional action. Sections 2, 9, 12, and 13 apply.
11. Beta & experimental features
We may offer features labeled beta, preview, experimental, or early access. These are provided “as is” and “as available,” may be changed or discontinued at any time, may be less reliable, and are excluded from any service commitment. Your use of them is at your own risk.
12. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. To the fullest extent permitted by law, we disclaim the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any content, feedback, currency or performance calculation, endorsement text, weather, or training outcome will be accurate, current, complete, or fit for any aeronautical purpose. No advice or information obtained from the Service creates any warranty not expressly stated here. Some jurisdictions do not allow certain disclaimers, so some may not apply to you.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, Aetherion Arc LLC and its Affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or for any personal injury or property damage arising from aeronautical decisions, arising out of or relating to the Service — even if advised of the possibility. Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amounts you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) US $100.
Carve-out. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under California law, including liability for gross negligence, recklessness, willful or intentional misconduct, or fraud (see Cal. Civ. Code §1668; City of Santa Barbara v. Superior Court (2007) 41 Cal.4th 747). The limits above apply only to the extent permitted by law.
14. Indemnification
You will defend, indemnify, and hold harmless Aetherion Arc LLC and its Affiliates and their officers, employees, and agents from any claims, damages, liabilities, and reasonable costs (including attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms or of any law or the FARs; (c) your User Content or data you upload; and (d) your aeronautical decisions.
Schools additionally indemnify us for the acts and omissions of their instructors, staff, and enrolled users in connection with the Service. Instructors additionally indemnify us for any endorsement, recommendation, sign-off, or logbook entry they make or apply through the Service. This section does not require you to indemnify us for our own gross negligence, willful misconduct, or fraud.
15. Medical & sensitive information
The Service may let you or your school record medical-certificate status and similar information to support training (for example, tracking whether a medical is current). We are not a healthcare provider or a HIPAA covered entity, and the Service does not provide medical or aeromedical advice — questions about medical certification belong to an Aviation Medical Examiner and the FAA. You choose what to provide, and you are responsible for the accuracy and lawful use of any medical or sensitive information you enter about yourself or others. We handle this information as described in our Privacy Policy, including the limits on how sensitive personal information is used.
16. Electronic signatures and records
You consent to transact with us electronically where the Service provides that option. An electronic signature or record may have legal effect under applicable law, including the federal ESIGN Act and relevant state law, when the applicable requirements are met. Atlas does not guarantee that every click, generated document, or stored record satisfies every FAA or other legal requirement.
Only apply a signature, approval, or sign-off that you intend to make and are authorized to make. Verify the record's contents and any required identity, retention, delivery, or consent conditions. You may withdraw consent to electronic records prospectively by contacting support, though doing so may prevent use of features that require them. Keep appropriate copies of records you need.
17. Dispute resolution — binding arbitration & class-action waiver
Please read this section carefully — it affects your rights.
17.1 Informal resolution first. Before starting arbitration, you and we agree to try to resolve the dispute informally for 30 days after written notice to support@atlascfi.com (or to you at your account email).
17.2 Binding arbitration. Except as carved out below, any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered by JAMS under its Consumer Arbitration Rules and Consumer Minimum Standards then in effect. The Federal Arbitration Act governs this Section. The arbitration will be held in California or, at your election, by phone/video or in your home county. The arbitrator decides all issues, except that a court decides the enforceability of the class-action waiver in 17.4.
17.3 Fees and remedies. The arbitration filing fee you pay will not exceed the amount required by the JAMS Consumer Minimum Standards, and we will bear the remaining JAMS fees as those standards require. The arbitrator may award any relief a court could award to you individually, including statutory remedies; nothing here limits non-waivable rights.
17.4 Class-action waiver. You and we agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any class or representative proceeding. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court, and the rest of this Section still applies.
17.5 Carve-outs. Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief to protect intellectual property or confidential information in court. These do not waive arbitration for other claims.
17.6 Your right to opt out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@atlascfi.com with your name, account email, and the statement “I opt out of arbitration.” Opting out does not affect any other part of these Terms. If you opt out, disputes go to the courts in Section 19.
18. Suspension and termination
We may restrict or terminate access for violations of these Terms, security threats, or other necessary protection of the Service and its users. Where appropriate and safe, we will explain the reason and provide an opportunity to address it. You may stop using Atlas, revoke a connector, or request account deletion through available settings or support@atlascfi.com. Canceling a paid subscription and deleting an account are separate actions.
Account deletion and retention follow the Privacy Policy, including treatment of independently retained school records and third-party assistant copies. Where reasonably practicable and lawful, we will provide a way to retrieve your records before a planned service closure. On termination, your license to use the Service ends. Provisions that by their nature should survive continue to apply, including applicable content-retention permissions, intellectual-property rights, liability provisions, dispute provisions, and outstanding purchase obligations.
19. Governing law & venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Subject to the arbitration agreement in Section 17, any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in California, and you consent to their jurisdiction.
20. Force majeure, severability, assignment & entire agreement
We are not liable for delays or failures caused by events beyond our reasonable control. If any provision of these Terms is found unenforceable, it will be limited or severed to the minimum extent necessary and the rest remains in effect. You may not assign these Terms; we may assign them to an Affiliate or in connection with a merger, acquisition, or sale of assets. These Terms, with the Privacy Policy and any order or checkout terms, are the entire agreement between you and us about the Service and supersede prior agreements. Our failure to enforce a provision is not a waiver.
An accepted purchase-specific order controls a conflict about that purchase's commercial terms, subject to non-waivable rights. It does not silently convert a separate free account into a paid subscription.
21. Export & sanctions
You represent that you are not located in, and will not use the Service in violation of, any U.S. embargo or on any U.S. government restricted-party list, and that you will comply with applicable export-control and sanctions laws.
22. Changes to these Terms
We will publish an updated version with a new effective date and provide notice by email or in-app at least 14 days before material changes take effect. Where acceptance is required, we will ask you to accept the new version. A change to these Terms does not by itself authorize a new charge or convert a free account to paid. If you do not accept an updated version, stop using the affected Service; contact support about access to your records and any existing purchase obligations.
